Terms and Conditions of Use

These Terms and Conditions of Use (“Terms”, of “Terms and Conditions”) govern all use of the Idaho Department of Fish and Game (collectively, “Idaho Fish and Game,” “IDFG,” “we,” “us,” or “our”) websites located at https://idfg.idaho.gov, https://gooutdoorsidaho.com/, https://gofishidaho.org, https://gohuntidaho.org (collectively, the “Websites”), mobile Apps, and customers of our services (together with the Websites and Apps, known as the “Services”). By accessing our Services, you are agreeing to be bound by these Terms and Conditions of Use, all applicable laws and regulations, and that you are responsible for compliance with any applicable local laws. If you do not agree with any of these Terms, you are prohibited from using or accessing the Services. The materials contained in our Services are protected by applicable copyright and trademark law. 

Idaho Fish and Game may revise these Terms of use for its Services at any time without notice. By using this website, you are agreeing to be bound by the current version of these Terms and Conditions.

Legal notices

All content included in or made available through any of our Services, such as text, graphics, logos, button icons, images, audio clips, digital downloads, data compilations, and software is the property of Idaho Fish and Game and protected by United States and international copyright laws. The compilation of all content included in or made available through our Services is the exclusive property of Idaho Fish and Game and is protected by U.S. and international copyright laws. 

Any trademarks that appear through our Services are the property of their respective owners who may or may not be affiliated with, connected to, or sponsored by Idaho Fish and Game. Idaho Fish and Game respects the rights of all copyright holders, and therefore, has adopted and implemented a policy that provides for the termination, in appropriate circumstances, of users and account holders who infringe upon the rights of copyright holders. 

If you believe that your work has been used through our Services, or that another work has been used in a way that constitutes copyright infringement, please provide Idaho Fish and Game with the following information required by the Online Copyright Infringement Liability Limitation Act of the Digital Millennium Copyright Act: 

  1. A physical or electronic signature of a person authorized to act on behalf of the owner of an exclusive right that is allegedly infringed; 
  2. Identification of the copyrighted work claimed to have been infringed, or, if multiple copyrighted works at a single online site are covered by a single notification, a representative list of such works at that site; 
  3. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit us to locate the material; 
  4. Information reasonably sufficient to permit us to contact the complaining party; 
  5. A statement that the complaining party has a good-faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law; and 
  6. A statement that the information in the notification is accurate, and under penalty of perjury, that the complaining party is authorized to act on behalf of the owner of an exclusive right that is allegedly infringed. 

Use License 

Permission is granted to temporarily download one copy of the materials (information or software) on our Websites for personal, non-commercial transitory viewing only. This is the grant of a license, not a transfer of title, and under this license, you may not: 

  • modify or copy the materials; 
  • use the materials for any commercial purpose, or any public display (commercial or non-commercial); 
  • attempt to decompile or reverse engineer any software contained on our Websites; 
  • remove any copyright or other proprietary notations from the materials; or 
  • transfer the materials to another person or “mirror” the materials on any other server. 

This license shall automatically terminate if you violate any of these restrictions and may be terminated by Idaho Fish and Game at any time. Upon terminating your viewing of these materials or upon the termination of this license, you must destroy any downloaded materials in your possession whether in electronic or printed format. 

Disclaimer

The materials found through our Services are provided “as is.” Idaho Fish and Game makes no warranties, expressed or implied, and hereby disclaims and negates all other warranties, including without limitation, implied warranties or conditions of merchantability, fitness for a particular purpose, or non-infringement of intellectual property or other violation of rights. Further, Idaho Fish and Game does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its Internet website or otherwise relating to such materials or on any sites linked to this site. 

Limitations

In no event shall Idaho Fish and Game or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption,) arising out of the use or inability to use the materials of our Services, even if Idaho Fish and Game or an Idaho Fish and Game authorized representative has been notified orally or in writing of the possibility of such damage.  

Revisions and errata

The materials appearing through our Services could include technical, typographical, or photographic errors. Idaho Fish and Game does not warrant that any of the materials found through our Services are accurate, complete, or current. Idaho Fish and Game may make changes to the materials contained through our Services at any time without notice. Idaho Fish and Game does not, however, make any commitment to update the materials. 

Links to external websites

Idaho Fish and Game has not reviewed all the sites linked to its Services and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement of the site by Idaho Fish and Game. Use of any such linked website is at your own risk. You should check the applicable Privacy Policy and Terms of Use of when visiting any such external sites. 

Governing law 

Any claim relating to our Services shall be governed by the laws of the State of Idaho without regard to its conflict of law provisions. 

Users of IDFG social and forum sites 

Many of Idaho’s citizens, Idaho Fish and Game nonresident customers, and other people interested in our mission use social media for news and communications.  To help us inform and communicate with the public about our work and mission, IDFG may create its own accounts and content on various social media forums and platforms. Comments left on Idaho Fish and Game accounts on these forums and platforms reflect the views of the commenters, not the views of this agency. 

IDFG is committed to fully complying with the freedom of speech clauses of the U.S. and Idaho Constitutions and other similar legal obligations surrounding free speech. When speech is legally protected, there may be times when comments made by users remain visible on our social media accounts and forums, even if they may be offensive to others.  

IDFG has an important interest in assuring the accuracy and consistency of information associated with our social media sites. These Terms establish guidelines for comments or other content posted by users on Fish and Game s’s accounts and content on various social media forums and platforms in a way that balances these values.   

Definition
  1. “Social media” means digital content created by us and communicated on platforms that allow sharing, commenting, and engagement by the public. Examples of social media accounts we may use are Facebook, Twitter, Instagram, YouTube, and LinkedIn. 
  2. “Comments” include any digital content, information, links, images, videos, or any other form of communicative content posted in reply or in response to a social media account post posted by us on one of our social media sites. 
  3. “User” means a member of the public who views or interacts with one or more of our social media accounts. 
Expectations 
  1. Idaho Fish and Game believes that honest, civil, and productive discussions provide the best environment for citizens and other people interested in our mission to understand and participate in the work of our government. 
  2. We expect commenters to consider that children and other impressionable people may view our social media feeds. We expect commenters to avoid profanity, slurs, personal attacks, bullying, or false information.  
Accountability

IDFG commits to regularly train its employees on this policy and relevant law on freedom of speech. IDFG also commits to hold employees accountable if they violate policy or law. 

General guidelines
  1. Anyone in need of emergency help should call 9-1-1. Idaho Fish and Game does not constantly monitor our social media accounts, and no one should use our social media accounts to seek emergency services.  
  2. These Terms and Conditions apply to all our social media sites. Where possible, a link to these Terms and Conditions will be made available as a hyperlink or posted as text somewhere on our social media accounts. 
  3. Users should know that social media posts we make, comments and replies to those posts, any direct or private messages to or from us, and any other information sent to us, including identities of commenters, may be subject to disclosure to other members of the public under Idaho Public Records law unless a specific exemption applies. We do not guarantee that we will respond to comments or messages sent on our social media accounts.  
  4. Idaho Fish and Game will not consider a post or comment that requests information or public records to be a request under Idaho Public Records law.  
Content moderation
  1. Limited Public Forum. Our social media accounts are created and maintained as limited public forums. We invite members of the public to view and, where possible and permitted, provide comments or other engagement on our social media posts. However, the law permits us to hide or delete comments that are not protected speech under the U.S. and Idaho Constitutions and other relevant law. As a general rule, we will not hide or delete comments solely because such comments are critical of IDFG or its officials. 
  2. Prohibited Content. As indicated above, we may hide or delete: 
  3. comments expressly advocating direct violence or other illegal activity; 
  4. comments containing or linking to obscenity, which is defined as sexually explicit and/or pornographic content that is patently offensive, appeals to prurient interest, and lacks serious literary, artistic, political, or scientific value; 
  5. comments that expressly encourage or advocate our agency to illegally discriminate based on race, age, religion, gender, national origin, disability, sexual orientation, veteran status, or any other legally protected class; 
  6. comments containing links to malware and/or malicious content that affects the normal functioning of a computer system, server, or browser; 
  7. duplicate comments posted repeatedly within a short period of time; 
  8. comments containing actual defamation against a specifically named person or organization, whether patently defamatory, defamatory by easily discovered facts, or determined to be defamatory by a court determination; 
  9. comments that contain images or other content that violate the intellectual property or copyright rights of someone else, if the owner of that property notifies us that the property was posted in a comment on our social media account. 
  10. comments that contain a hyperlink to any website other than those controlled by IDFG. This will be done without regard to the viewpoint of the comment containing such a link or the content of the site to which the link redirects. 
  11. Retention. When we hide or delete a comment containing any of the above content posted to our social media account, we may archive or otherwise retain a copy or electronic record of that content, along with a brief description of the reason the specific content was deleted. 
Appeal
  1. If our staff hides or deletes a user’s comment pursuant to these Terms and Conditions, the user has the right to appeal that decision by sending an email or letter to directorsoffice@idfg.idaho.gov within five business days.  
  2. Upon receipt of an appeal, Idaho Fish and Game will determine whether the comment at issue contained content protected by law. If the appeal is successful, the comment may (if possible) be restored for public view, or the user may be permitted to repost the comment. Upon a determination that the comment was not protected by law, the user will be notified that the appeal was denied. 
  3. Blocking or Banning a User. When we determine that a user has violated these Terms and Conditions on three or more occasions within a twelve-month rolling period, we may block or ban the offending user from our social media account where the violations occurred. 

If we block or ban a user, we will (a) reasonably attempt to notify the user; (b) describe the violation(s); and (c) explain the appeal process. 

If the appeal is successful and the user has not violated this policy three times within a rolling 12-month period, we will unblock or unban the user from the social media account. If the appeal is not successful, our decision will stand. 

Mobile services

Our Services may be made available to you via your mobile phone or other mobile devices if you have subscribed to them, including the ability to use your mobile device to place orders, receive and reply to messages from Idaho Fish and Game, and access certain other features. Mobile devices or mobile apps may be subject to additional Terms and Conditions.
